29 CFR 1910.178(l)(1)(i): The employer did not ensure that each powered industrial truck operator is competent to operate a powered industrial truck safely, as demonstrated by the successful completion of the training and evaluation specified in this paragraph (l): (a) Throughout the Facility - On or about August 2, 2012, employees were operating the 345C MH Cat Excavator, the 921C Case Loader, and a bobcat for their work on the docks and barges. While employees had been trained under paragraph 1910.178(l) on the operation of the forklift located in the facility, they had not been trained on the excavator, loader, or bobcat beyond a hands on training. The employees had not received formal classroom training or an evaluation of their performance in the workplace.

29 CFR 1917.118(e)(2)(iii): The employer did not provide a landing platform meeting all of the required criteria of being capable of supporting a load of 100 pounds per square foot and fitted with guard rails complying with 29 CFR 1917.112(c) and provided at least every 30 feet: (a) On the Grain Dock Conveyor Structure - On or about August 2, 2012, a platform between two fixed ladders was found which did not have all the required guard rails. The platform was higher than 6 feet to the platform below it. A protective gate needed to be placed in front of the ladder to protect employees from inadvertently falling.
