29 CFR 1926.501(b)(1): Each employee on a walking/working surface (horizontal and vertical surface) with an unprotected side or edge which is 6 feet (1.8 m) or more above a lower level was not protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems: A. Peterson Construction Co. worksite located at 252 Orchard Dr., Leipsic, Ohio: On or about August 8, 2012, the employer did not ensure employees were protected from falling approximately 19.00 feet while walking on the top of the south wall of the SBR Tank. The exposed employee was signaling the crane operator from the top of the wall exposing the employee to a fall hazard.

29 CFR 1926.651(c)(2): A stairway, ladder, ramp or other safe means of egress was not located in trench excavations that are 4 feet (1.22 m) or more in depth so as to require no more than 25 feet (7.62 m) of lateral travel for employees: A. Peterson Construction Co. worksite located at 252 N. Orchard Dr., Leipsic, Ohio: On or about August 8, 2012, the employer did not ensure a safe means of egress such as a ladder was provided to an employee installing a sanitary line in a trench approximately 14.00 feet deep. The employee was working in the trench box with no ladder present in the excavation.
