29 CFR 1910.132(a): Protective equipment, including personal protective equipment for eyes, face, head, and extremities, protective clothing, respiratory devices, and protective shields and barriers, was not provided and used wherever it was necessary by reason of hazards of processes or environment, chemical hazards, radiological hazards, or mechanical irritants encountered in a manner capable of causing injury or impairment in the function of any part of the body through absorption, inhalation or physical contact:    On or about August 9, 2012, in the facility, employees required to add water to forklift batteries were exposed to the hazard of contact with corrosive acid.  Protective equipment, including protective clothing (apron), gloves and faceshield was not provided and used to protect against injury.

29 CFR 1910.151(c): Where the eyes or body of any person was exposed to injurious corrosive materials, suitable facilities for quick drenching or flushing of the eyes and body were not provided within the work area for immediate emergency use:    On or about August 9, 2012, in the facility, employees required to add water to forklift batteries were exposed to the hazard of contact with corrosive acid.  Suitable facilities for quick drenching or flushing of the eyes (i.e. emergency eyewash unit) were not provided within the work area for immediate emergency use.

29 CFR 1910.178(l)(1)(ii):  Prior to permitting an employee to operate a powered industrial truck (except for training purposes), the employer did not ensure that each operator had successfully completed the training required by this paragraph (l), except as permitted by paragraph (l)(5):    On or about August 9, 2012, in the facility, employees were required to operate powered industrial trucks including forklift trucks, platform lift trucks (Wave) and motorized hand trucks.  Prior to permitting an employee to operate a powered industrial truck (except for training purposes), the employer did not ensure that each operator had successfully completed the required training.
