29 CFR 1926.451(g)(1): Each employee on a scaffold more than 10 feet (3.1 m) above a lower level shall be protected from falling to that lower level. Paragraphs (g)(1)(i) through (vii) of this section establish the types of fall protection to be provided to the employees on each type of scaffold. Paragraph (g)(2) of this section addresses fall protection for scaffold erectors and dismantlers.    a. On or about August 9, 2012 - at the above addressed jobsite, an employee was offloading cinder blocks from a platform pallet attached to the forks of a Toyota Forklift Model 42-5FG17, approximately ten (10) feet three (3) inches above the ground, thereby exposing the employee to fall hazards.

29 CFR 1926.501(b)(1): "Unprotected sides and edges." Each employee on a walking/working surface (horizontal and vertical surface) with an unprotected side or edge which is 6 feet (1.8 m) or more above a lower level shall be protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems.    a.  On or about August 9, 2012- at the above addressed jobsite, employees performing material offloading operations from a garage roof deck, approximately twelve (12) feet above the ground, were not protected from falls, thereby exposing the employees to fall hazards created by the presence of unprotected sides.
