29 CFR 1926.20(b)(1): It shall be the responsibility of the employer to initiate and maintain such programs as may be necessary to comply with this part. Employees conducting road work on a two lane roadway and employees were exposed to being struck by motorist due to a lack of traffic control devices. The employer did not initiate and maintain an accident prevention program to control and eliminate the hazards present at the jobsite in accordance with the OSHA regulations.

29 CFR 1926.20(b)(2): Such programs shall provide for frequent and regular inspections of the job sites, materials, and equipment to be made by competent persons designated by the employers. Employees conducting painting operations on a two lane roadway were exposed to being struck by motorist and the employer did not initiate and maintain programs which provided for frequent and regular inspections of the job site, materials and equipment to be made by a competent person.

29 CFR 1926.201(a): Signaling by flaggers and the use of flaggers, including warning garments worn by flaggers did not conform to Part VI of the Manual on Uniform Traffic Control Devices, (1988 Edition, Revision 3 or the Millennium Edition), Employees conducting flagging and/or painting operations on a two lane roadway were not conforming to Part VI of the Manual on Uniform Traffic Control Devices. The employer did not provide and ensure the use of appropriate approach signage, and placards or red flags to control traffic while a flagging operation was underway.
