29 CFR 1926.652(a)(1): Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652(c). The employer had not complied with the provisions of 29 CFR 1926.652(b)(1)(i) in that that (a) At the intersection of S. 7th St. and Spring Ave. in West Bend, WI, an employee of Heartland Construction, Inc. was exposed to a cave-in hazard while conducting pipe connections in an unprotected trench approximately 10 feet deep. The competent person determined the trench required cave-in protection, but failed to provide the employee with the required protection. This exposed an employee to a cave-in/engulfment hazard.

29 CFR 1926.651(k)(2): Where the competent person found evidence of a situation that could result in possible cave-in, indications of failure of protective systems, hazardous atmospheres, or other hazardous conditions, exposed employee(s) was/were not removed from the hazardous area until the necessary precautions have been taken to ensure their safety. (a) At the intersection of S. 7th St. and Spring Ave. in West Bend, WI, an employee of Heartland Construction, Inc. was exposed to cave-in hazard while conducting pipe connections in an unprotected trench. The competent person determined the trench required cave-in protection, but failed to remove the employee form the unprotected trench. This exposed an employee to an engulfment hazard.
