29 CFR 1926.451(c)(2)(v):   Forklift was used to support a scaffold platform; the entire platform was not attached to the fork, and the forklift was moved horizontally while the platform was occupied:    On August 3, 2012, an employee was exposed to a fall to the ground from a height of up to approximately 36 feet, while riding on the unattached forklift platform up to the roof of the two-story apartment building, while the forklift was being driven.

29 CFR 1926.454(a):   The employer did not have each employee who performs work while on a scaffold trained by a person qualified in the subject matter to recognize the hazards associated with the type of scaffold being used and to understand the procedures to control or minimize those hazards:    On August 3, 2012, an employee was working from a platform on the extended arm of a forklift which served as a scaffold, without having been trained to be aware of the hazards of riding this equipment without any form of fall protection.

29 CFR 1926.501(b)(13):   Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels was not protected by guardrail systems, safety net system, or personal fall arrest system unless another provision in paragraph (b) of this section provides for an alternative fall protection measure:    On August 3, 2012, an employee was exposed to a fall to the ground from a height of approximately 36 feet, while working on the roof of a two-story apartment building, removing siding from the chimney, without any form of fall protection.
