OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees. The employer failed to ensure that employee(s) operating a 2006 Yamaha Grizzly 660 All-Terrain Vehicle (ATV) on rough, sloped, uneven terrain had been trained, were qualified, and safely operated ATVs including, but not limited to, appropriate speeds, operating surfaces, emergency braking and maneuvers, tire pressures, and driving behavior. On or before 08/07/12 employee(s) were exposed to the hazard of rollover and/or struck by while operating an All-Terrain Vehicle (ATV) on a lease road in Seminole, TX GPS coordinates N32.71940 W102.67629.
