29 CFR 1926.651(j)(2): Protection was not provided by placing and keeping excavated or other materials or equipment at least 2 feet (.61m) from the edge of excavations, or by the use of retaining devices that were sufficient to prevent materials or equipment from falling or rolling into excavations, or by a combination of both if necessary: The employer does not ensure that excavated material is placed or retained so that it does not pose a hazard to employees. This violation was observed on or about August 09, 2012, when employees working in an excavation were exposed to struck-by hazards from the excavated material that was not retained or placed at least 2 feet from the excavation edge. UST Systems was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.651(j)(2), which was contained in OSHA inspection number 312926215, citation number 01 item number 003 and was affirmed as a final order on July 20, 2011, with respect to a workplace located at 1050 IH-10 South, Beaumont, TX 77707.

29 CFR 1926.652(a)(1): Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652 paragraph (b) or (c): The employer does not ensure that employees are protected from cave-ins while working in excavations. This violation was observed on or about August 09, 2012, when employees were exposed to cave-in hazards while working in an excavation that was not sloped, benched or shored. UST Systems was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.652(a)(1), which was contained in OSHA inspection number 312926215, citation number 01 item number 004 and was affirmed as a final order on July 20, 2011, with respect to a workplace located at 1050 IH-10 South, Beaumont, TX 77707.
