29 CFR 1926.451(b)(1): Each platform on all working levels of scaffolds was not fully planked or decked between the front uprights and the guardrail supports as specified in paragraphs 1926.451(b)(1)(i)-(ii). On or about August 9, 2012 and times prior thereto, employees of Haney Contractors, LLC were painting the siding of a two story law firm located at or near 308 E. 8th Street in Little Rock, Arkansas while on a scaffold. Employees were observed working from the second and third tier platforms of the scaffold which were not fully planked, exposing the employees to falling distances of greater than 12 feet.

29 CFR 1926.451(e)(1): When scaffold platforms were more than 2 feet (0.6 m) above or below a point of access, portable ladders, hook-on ladders, attachable ladders, stair towers (scaffold stairways/towers), stairway-type ladders (such as ladder stands), ramps, walkways, integral prefabricated scaffold access, or direct access from other scaffold, sturcure, personnel hoist, or similar surface was not used. Cross braces were used as a means of access. On or about August 8, 2012 and times prior thereto, employees of Haney Contractors, LLC were working from a scaffold to paint the siding of a two story law firm located at or near 308 E. 8th Street in Little Rock, Arkansas. An employee was observed accessing the third tier of the scaffolding by climbing on the scaffold structural members and cross bracing, exposing the employee to falling hazards of greater than 12 feet to the ground level below.

On or about August 9, 2012 and times prior thereto, employees of Haney Contractors, LLC worked from a three (3) tier scaffold to paint the siding of a two story law firm located at or near 308 E. 8th Street in Little Rock, Arkansas. The scaffolding had been erected by the On-Site Supervisor who had no training or knowledge of scaffold requirements.
