29 CFR 1926.1433(d)(4)(iii): The latch did not close the throat opening and was not designed to retain slings or other lifting devices/accessories in the hook when the rigging apparatus is slack. The employer does not ensure that latches on hoisting hooks close to prevent the rigging from coming off the hook. This violation was observed on or about August 9, 2012, at the construction site where employees were exposed to struck-by hazards while hoisting an air conditioning unit onto a roof without a functioning safety latch on the hoisting hook.
