29 CFR 1926.1424(a)(2)(ii): Where erection and maintenance control lines, warning lines, railings, or similar barriers is not feasable on the ground or equipment, harzard areas were not marked by a combination of warning signs (such as DANGER-Swing/Crush Zone) and high visibility markings on the equipment that identify the hazard areas: On or about July 28, 2012, at this site, a Grove 120 ton mobile cranw was operated on an oilfield site near Cotulla, TX. The erection and maintenance of control lines, warning lines, railings, or similar barriers was not feasible on the ground. Potential swing/crush zone warning signs were not posted to make Mobile Crane Services' employees aware of potential struck-by and crushing hazards by the rotating superstructure of the crane.

29 CFR 1910.180(d)(3): Frequent inspections did not identify defects at intervals as defined in paragraph (d)(2)(i) of this section or as specifically indicated including observation during operation for any defects which might appear between regular inspections. Any deficiencies such as listed were not carefully examined and determination made as to whether they constituted a safety hazard: On or about July 30, 2012, at this site, the Grove GMK-5120-B 120-ton mobile crane was not inspected prior to assignment and use for defects including but not limited to, a cracked windshield on the lower vehicle.
