29 CFR 1926.100(a):  Employees were not protected by protective helmets while working in areas where there was a possible danger of head injury from impact, or from falling or flying objects, or from electrical shock and burns:    On or about August 2, 2012, while working at an excavation site, employees were not wearing protective head gear while working in a trench ranging from 6 feet 6 inches to 8 feet 6 inches deep, exposing them to the hazard of being struck by falling objects.

29 CFR 1926.651(k)(1): Daily inspections of excavations, the adjacent areas, and protective systems were not made by a competent person for evidence of a situation that could have resulted in possible cave-ins, indications of failure of protective systems, hazardous atmospheres, or other hazardous conditions:    On or about August 2, 2012, while working at an excavation site, daily inspections of an open trench were not conducted prior to employees entering the trench to conduct work, exposing the employees to the hazard of being crushed by the soil.
