29 CFR 1910.334(a)(2)(ii): When there was a defect or evidence of damage that might expose an employee to injury, the defective or damaged item was not removed from service, and no employee may use it until repairs and tests necessary to render the equipment safe have been made: (a) At the project on or about August 13, 2012, and at times prior thereto, the cord to a 110 VAC Black and Decker Industrial Heavy Duty drill was damaged in several places. The drill was used to mix mortar.

29 CFR 1926.95(a): Protective equipment, including personal protective equipment for eyes, face, head, and extremities, protective clothing, respiratory devices, and protective shields and barriers, were not provided, used, and maintained in a sanitary and reliable condition wherever it was necessary by reason of hazards of processes or environment, chemical hazards, radiological hazards, or mechanical irritants encountered in a manner capable of causing injury or impairment in the function of any part of the body through absorption, inhalation or physical contact: (a) At the project on or about August 13, 2012, and at times prior thereto, appropriate hand protection was not used when mixing and applying Custom Blend Standard Thin Set Mortar that contained Portland cement. Gloves were used with the palm sides made of rubber instead of nitrile or butyl. In addition, some employees did not wear eye protection.
