OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees:    On or about 07/25/2012, during maintenance and servicing activities of the McCloskey vibrating screener, the employer did not provide a workplace free from recognized hazards by allowing an employee(s) to be transported by, and to work from, the bucket of a Komatsu excavator.

29 CFR 1910.147(c)(1): The employer did not establish a program consisting of an energy control procedure, employee training and periodic inspections to ensure that before any employee performed any servicing or maintenance on a machine or equipment where the unexpected energing, startup or release of stored energy could occur and cause injury, the machine or equipment shall be isolated from the energy source and rendered inoperative    As of 07/25/2012 the employer failed to establish an effective program for the control of hazardous energy at the site.  Employees perform service and maintenance on equipment such as, but not limited to, the McCloskey vibrating screener.

29 CFR 1910.1200(h)(1): Employers did not provide employees with effective information and training on hazardous chemicals in their work area at the time of their initial assignment, and whenever a new physical or health hazard the employees had not previously been trained about was introduced into their work area and chemical-specific information was not always available through labels and material safety data sheets:        Employees were not trained on the hazardous chemicals introduced into the workplace. Chemicals include, but are not limited to, hydraulic fluid, spray silicone, propane, and iron ore.
