Occupational Safety and Health Act of 1970, as amended (the "OSH ACT"), Section (5)(a)(1): The employer did not furnish to its employees employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to those employees in that they were exposed to the unexpected structural failure of a conveyor belt.    On 07/25/2012, the employre failed to assure that a bulk-material conveyor belt was rendered safe from recognized hazards during its employees' maintenance, repair, or modification of that belt.  A feasible and acceptable method to abate this violation would be the development and implementation of a standard operating procedure that addresses the operational and safety concerns relating to conveyor-belt maintenance, repair, and modification.

29 CFR 1910.22(a)(1): All places of employment, passageways, storerooms or service rooms were not kept clean and orderly or in a sanitary condition.      Before maintenance, repairs, or modifications were undertaken with respect to a bulk-material conveyor belt on 07/25/2012, the catwalk alongside that belt was not cleared of built-up sand, con-crete, and other debris creating a potential fall hazard.

29 CFR 1910.132(a): Protective equipment was not used when necessary whenever hazards capable of causing injury and impairment were encountered:      On or before 07/25/2012 fall protection was not provided for workers completing repair/splicing activities on the belt, of the Company's belt conveyor unit.  Located in the yard area of the site, the belt conveyor measures approximately 40-60 feet, from the head of the conveyor to ground level.        CARR BROS, INC WAS PREVIOUSLY CITED FOR A VIOLATION OF THIS OCCUPATIONAL SAFETY AND HEALTH STANDARD OR ITS EQUIVALENT STANDARD, 29 CFR 1910.132(a) WHICH WAS CONTAINED IN OSHA INSPECTION NUMBER 314416405, CITATION NUMBER 1, ITEM NUMBER 02(a), AND WAS AFFRIMED AS A FINAL ORDER ON 10/25/2010, WITH RESPECT TO THE WORK PLACE LOCATED AT 7177 NORTHFIELD RD., BEDFORD, OH 44146

As of 07/26/2012, all recordable injuries and illnesses had not been entered on the employers OSHA 300 Log and in 301 Incident Re-ports, as required. Additionally, those records were not provided within four (4) business hours to OSHAs Compliance Safety and Health Officer after they were requested on 07/26/2012.
