29 CFR 1926.95(a): Personal protective equipment was not used wherever it is necessary by reason of hazards of processes or environment encountered in a manner capable of causing injury or impairment in the function of any part of the body through absorption, inhalation or physical contact.    a)  Englobal at Wilson Ave. and Carlisle Drive, Loveland, CO 80538:  On or before August 11, 2012 the employer did not ensure that an employee wore high-visibility apparel when performing survey work on a four lane, 35 mph city street.  Condition exposed employees to struck-by hazards from moving vehicles.    Among other methods, one feasible and acceptable abatement method is recognized by the Federal Highway Administration's Worker Visibility Rule.  Section 23 634.3 of this rule provides, "All workers within the right-of-way of a Federal highway who are exposed either to traffic (vehicles using the highway for purposes of travel) or to construction equipment within the work area shall wear high-visibility safety apparel."  The preamble for this rule provides that "High visibility is one of the most prominent needs for workers who must perform tasks near moving vehicles or equipment."
