29 CFR 1926.451(e)(1): When scaffold platforms are more than 2 feet (0.6 m) above or below a point of access, portable ladders, hook-on ladders, attachable ladders, stair towers (scaffold stairways/towers), stairway-type ladders (such as ladder stands), ramps, walkways, integral prefabricated scaffold access, or direct access from another scaffold, structure, personnel hoist, or similar surface shall be used. Cross braces shall not be used as a means of access.    a) Sidewalk shed on Marine Ave. side, north of jobsite:    An employee was working on a 10-foot-high sidewalk shed, and then climbed down the cross braces of an adjacent supported scaffold to ground. Employee slipped and fell as he was climbing down the cross braces. Cross braces was used as a means of access.  On or about 08/09/12.    NOTE:  THE EMPLOYER IS REQUIRED TO SUBMIT CERTIFICATION OF ABATEMENT FOR THIS ITEM.  FAILURE TO COMPLY MAY RESULT IN AN ADDITIONAL PENALTY OF $1,000 AS PER 29 CFR 1903.19.

29 CFR 1926.451(g)(1):  Each employee on a scaffold more than 10 feet (3.1 m) above a lower level shall be protected from falling to that lower level. Paragraphs (g)(1)(i) through (vii) of this section establish the types of fall protection to be provided to the employees on each type of scaffold. Paragraph (g)(2) of this section addresses fall protection for scaffold erectors and dismantlers.    a) Sidewalk shed on Marine Ave. side, north of jobsite:    An employee was working on a 10-foot-high sidewalk shed. The interior side of the sidewalk shed was open and the employee was not protected from falling to ground by the use of fall protection systems. The employee was exposed to falling approximately 10 feet. On or about 08/09/12.    NOTE:  THE EMPLOYER IS REQUIRED TO SUBMIT CERTIFICATION OF ABATEMENT FOR THIS ITEM.  FAILURE TO COMPLY MAY RESULT IN AN ADDITIONAL PENALTY OF $1,000 AS PER 29 CFR 1903.19.

29 CFR 1926.454(a): The employer shall have each employee who performs work while on a scaffold trained by a person qualified in the subject matter to recognize the hazards associated with the type of scaffold being used and to understand the procedures to control or minimize those hazards.    a) Jobsite:    The employer did not provide training to an employee who worked from a sidewalk shed. Employee could not recognize hazards associated with scaffolds, and was exposed to hazards, including but not limited to: climbing cross braces of supported scaffold as a means of access, and falling approximately 10 feet from sidewalk shed to ground. On or about 08/09/12.    NOTE:  IN ADDITION TO CERTIFICATION OF ABATEMENT, THE EMPLOYER IS REQUIRED TO SUBMIT DOCUMENTATION OF ABATEMENT FOR THIS ITEM.  FAILURE TO COMPLY MAY RESULT IN AN ADDITIONAL PENALTY OF $1,000 AS PER 29 CFR 1903.19.
