29 CFR 1910.1200(e)(1): The employer did not develop, implement, and/or maintain at the workplace a written hazard communication program which describes how the criteria specified in 29 CFR 1910.1200(f), (g), and (h) will be met:    a. On or about 07/31/12, at the warehouse area, at Hunter Food & Spirits, St. Thomas, VI. The employer did not implement their written hazard communication program to ensure having material safety data sheets for the use and/or handling of Exide/Ironclad and Power-Flow batteries (sulfuric acid) when employees checked their water levels during Yale, Crown and Clark power industrial trucks maintenance operation.     NOTE 1: Hunter Food & Spirits was previously cited for a violation of this Occupational Safety and Health standard or its equivalent standard which was contained in OSHA Inspection Number 313532277, Citation Number 1, Item Number 2(a) Issued on 02/16/2010, with respect to a workplace located at 11 Peters Rest, St. Croix, VI.      NOTE 2: Hunter Food & Spirits was previously cited for a violation of this Occupational Safety and Health standard or its equivalent standard which was contained in OSHA Inspection Number 306193582, Citation Number 1, Item Number 2(a) Issued on 07/21/2008, with respect to a workplace located at 7350 Estate Nazareth, C101, St. Thomas, VI.       NOTE 3: Certification and documentation of abatement must be submitted for this citation item as required by 29 CFR 1903.19(c) and (d), respectively.
