29 CFR 1910.147(c)(1):     The employer did not establish a program consisting of an energy control procedure, employee training and periodic inspections to ensure that before any employee performed any servicing or maintenance on a machine or equipment where the unexpected energing, startup or release of stored energy could occur and cause injury, the machine or equipment shall be isolated from the energy source and rendered inoperative:    On or about Friday August 10, 2012 at 4367 Old McDonough Road Conley, Georgia 30288;    a). An energy control program for the hydraulic and gravity sources was not developed where an employee was fatally injured while performing maintenance under the raise cab of the tractor truck without being locked or tagged out to prevent the cab from falling and striking the employee.

29 CFR 1910.1200(e)(1): The employer did not develop, implement, and/or maintain at the workplace a written hazard communication program which describes how the criteria specified in 29 CFR 1910.1200(f), (g), and (h) will be met:    On or about Monday August 13, 2012 in the maintenance shop area;    a). A written hazard communication plan was not developed where employees are required to work with chemicals such as but not limited to: oxygen, acetylene, transmission fluid, and propane as a part of their daily duties.

29 CFR 1910.1200(h)(1): The employer did not provide employees with effective information and training on hazardous chemicals in their work area at the time of their initial assignment, and whenever a new physical or health hazard the employees had not previously been trained about was introduced into their work area    On or about Monday August 13, 2012 in the maintenance shop area;    a). Hazard communication training was not provided where employees were required to work with chemicals that included but were not limited to: oxygen, acetylene, transmission fluid, and propane.
