29 CFR 1926.300(b)(1): When power operated tools were designed to accommodate guards, they were not equipped with such guards when in use: On the back porch: On August 14, 2012, and at times prior thereto, there was no guard on a 110 VAC Ryobi chop saw used to cut crown molding. A warning label on the saw said failure to have a guard can cause serious injury.

29 CFR 1926.95(a): Protective equipment, including personal protective equipment for eyes, face, head, and extremities, protective clothing, respiratory devices, and protective shields and barriers, were not provided, used, and maintained in a sanitary and reliable condition wherever it was necessary by reason of hazards of processes or environment, chemical hazards, radiological hazards, or mechanical irritants encountered in a manner capable of causing injury or impairment in the function of any part of the body through absorption, inhalation or physical contact: In the living room: On August 14, 2012, and at times prior thereto, gloves and eye protection were not worn while painting with a roller overhead. The paint was Behr Premium Plus Ceiling Paint, Ulttra Pure White, No. 558. The warning label on the container stated to wear eye protection and protective clothing.
