29 CFR 1918.22(e): The employer did not provide a net or other suitable protection where the gangway overhung the water so that there was danger of employees falling between the ship and the dock.      a)  M/V NEMTAS-2, portside accomodation ladder:  The employer did not provide a net or other protection when there was danger of an employee falling between the ship and the dock. There was a three foot gap between the dock and the ladder which was not covered by the net.

29 CFR 1918.22(f): The space between the foot of the gangway and the apron was more than 1 foot (0.30m), and was not bridged by a firm walkway equipped with a hand rail (with a minimum height of approximately 33 inches (0.84m)) with midrails on both sides:       a)  M/V NEMTAS-2, portside accommodation ladder:  The space between the dock and the gangway was more than one foot and the employer did not provide firm walkway equipped with a handrail with a minimum height of approximately 33 inches in height with midrails on both sides. There was a three foot gap between the dock and the ladder which exposed the employee to a fall into the water.
