29 CFR 1926.501(b)(13): Employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph (b): (a) Nittany Crossing Building Three - Employees were installing a new roof on a three story apartment building, with a slope of eight in twelve, and were exposed to a fall of approximately 38 feet, and the employer did not ensure employees were using fall protection, on or about August 9, 2012. Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and states employees and their representatives were informed of this abatement.

29 CFR 1926.852(a): Material was dropped to points lying outside the exterior walls of the structure which had not been effectively protected: (a) Nittany Crosing - Building Three - Employees were removing the existing roof of the building and dropping debris to the ground below, and the area below was not protected, exposing employees on the ground to being struck by debris, on or about August 9, 2012. Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and states employees and their representatives were informed of this abatement.
