29 CFR 1910.95(g)(6):     At least annually after obtaining the baseline audiogram, the employer did not obtain a new audiogram for each employee exposed at or above an 8-hour time-weighted average of 85 decibels:    a) In the pallet repair shop, on or about August 15, 2012, annual audiometric testing was not provided for a nail gun operator who was exposed to noise at 132% of the action level (8-hour time-weighted average sound level of 85 dBA) or an equivalent sound level of 87.0 dBA during the 346 minute sampling period, resulting in a noise hazard.  The exposure calculation included a zero increment for the 134 minutes not sampled.    b) In the pallet repair shop, on or about August 15, 2012, annual audiometric testing was not provided for a nail gun operator who was exposed to noise at 167% of the action level (8-hour time-weighted average sound level of 85 dBA) or an equivalent sound level of 88.6 dBA during the 431 minute sampling period, resulting in a noise hazard.  The exposure calculation included a zero increment for the 49 minutes not sampled.
