29 CFR 1926.28(a): The employer is responsible for requiring the wearing of appropriate personal protective equipment in all operations where there is an exposure to hazardous conditions or where this part indicates the need for using such equipment to reduce the hazards to the employees. At this excavation site, employees working inside a trench were not wearing hard hats exposing employees to the possible spillage of soil or falling materials.

29 CFR 1926.651(c)(2): A stairway, ladder, ramp or other safe means of egress shall be located in trench excavations that are 4 feet (1.22 m) or more in depth so as to require no more than 25 feet (7.62 m) of lateral travel for employees. At this excavation site, employees worked inside a trench with vertical walls at 4 feet deep by 47 inches wide by 37 feet in length to install a water line. There was not a ladder in the trench for egrees from the trench.
