29 CFR 1910.132(d)(2):  The employer did not verify that the required workplace hazard assessment has been performed through a written certification which included the requirements as outlined in 29 CFR 1910.132(d)(2):  (a)  Goodies Auto Inc at 500 S Lincoln Ave, Loveland, CO 80537:  On and before August 15, 2012, the employer did not ensure that the required workplace hazard assessment has been performed for the facility.  The facility includes operations such as, but not limited to, painting, priming, sanding, body filler application, metal work including welding, cleaning of spray nozzles, and general housekeeping.  This condition potentially exposes employees to hazards such as, but not limited to, chemical spray or splash, fire, flying particles, sparks, hot surfaces, and light radiation.  Abatement Note:  The written certification shall identify the following:  (1)  The workplace evaluated;  (2)  The person certifying that the evaluation has been performed;  (3)  The date(s) of the hazard assessment; and,  (4)  The document as a certification of hazard assessment.  Abatement Note:  Abatement certification is required for this item (see enclosed Certification of Corrective Action Worksheet).

29 CFR 1910.134(c)(2)(ii):  The employer did not establish and implement those elements of a written program necessary to ensure that any employee using a respirator voluntarily was medically able to use that respirator, and that the respirator was cleaned, stored, and maintained so that its use does not present a health hazard to the user:   (a)  Goodies Auto Inc at 500 S Lincoln Ave, Loveland, CO 80537:  On and before August 15, 2012, the employer did not establish and implement those elements of a written program necessary to ensure that any employee using a respirator voluntarily was medically able to use that respirator, and that the respirator was cleaned, stored, and maintained so that its use does not present a health hazard to the user.  An employee conducting painting operations wore half-mask elastomeric respirators.  This employee had not received a medical evaluation and did not store the respirator appropriately to protect it from becoming contaminated.  This condition exposes employees to the physiological hazards of wearing a respirator without the evaluation of a physician or other licensed healthcare professional.    Abatement Note:  The employer shall include in the program the following provisions of 29 CFR 1910.134 as applicable:  (1)  Procedures for selecting respirators for use in the workplace;  (2)  Medical evaluations of employees required to use respirators;  (3)  Fit testing procedures for tight-fitting respirators;  (4)  Procedures for proper use of respirators in routine and reasonably foreseeable emergency situations;  (5)  Procedures and schedules for cleaning, disinfecting, storing, inspecting, repairing, discarding, and otherwise maintaining respirators;  (6)  Procedures to ensure adequate air quality, quantity, and flow of breathing air for atmosphere-supplying respirators;  (7)  Training of employees in the respiratory hazards to which they are potentially exposed during routine and emergency situations;  (8)  Training of employees in the proper use of respirators, including putting on and removing them, any limitations on their use, and their maintenance; and,  (9)  Procedures for regularly evaluating the effectiveness of the program. This condition potentially exposes the employees to respiratory hazards associated with each of these tasks. 29 CFR 1910.1200(e)(1):  The employer did not develop, implement, and/or maintain at the workplace a written hazard communication program which describes how the criteria specified in 29 CFR 1910.1200(f), (g), and (h) will be met:  (a)  Goodies Auto Inc at 500 S Lincoln Ave, Loveland, CO 80537:  On and before August 15, 2012, the employer did not develop, implement, and maintain at the workplace a written hazard communication program encompassing identification, labeling, Material Safety Data Sheets, and training for hazardous chemicals used at Goodies Auto Inc.  The employer conducts priming and body prep operations which exposes employees to chemicals such as, but not limited to, ChromaSurfacer 7701S, ChromaBase 7785S, ChromaClear G2-7779S, and ChromaSystem Basemaker 7160S.  These paints and priming materials contain chemicals such as, but not limited to, methyl ethyl ketone, isophorone diisocyanate homopolymer, 1,2,4-trimethylbenzene, and cumene.  Employees are also exposed to laquer thinner during cleaning operations.  Abatement Note:  The written Hazard Communication Program will also include:  (1)  A list of the hazardous chemicals known to be present using an identity that is referenced on the appropriate materials safety data sheet (the list may be compiled for the workplace as a whole or for individual work or for individual work areas); and,  (2)  The methods the employer will use to inform employees of the hazards of non-routine tasks (for example, the cleaning of reactor vessels), and the hazards associated with chemicals contained in unlabeled pipes in the work areas.  Abatement Note:  Employers shall be provide  employees with effective information and training on hazardous chemicals in their work area at the time of their initial assignment, and whenever a new physical hazard or health hazard the employees have not previously been trained about is introduced into their work area.  Information and training may be designed to cover categories of hazards (e.g. flammability, carcinogenicity) or specific chemicals. Employees use chemicals such as, but not limited to:  (1)  ChromaSurfacer 7701S;  (2)  ChromaBase 7785S;  (3)  ChromaClear G2-7779S;  (4)  ChromaSystem Basemaker 7160S; and,   (5)  Lacquer thinner;  (6)  Bondo body filler; and,  (7)  Duraglas body filler.
