OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees:    On or about 8/15/12, at 7007 NW 30th Street, in the city of Doral, a warehouse employee was observed operating a Caterpillar forklift without using the equipped seatbelt.      Among other methods, one feasible and acceptable means of abatement would be to follow the forklift's manufacturers recommendation regarding wearing seatbelts during operation of the powered industrial truck.

29 CFR 1910.178(p)(1): Where powered industrial trucks were found to be in need of repair, defective, or in any way unsafe, the trucks were not taken out of service until they had been restored to safe operating condition:    On 8/15/12, at 7007 NW 30th Street, in the city of Doral, a Caterpillar forklift's audible back-up alarm was inoperable.    PLEASE NOTE: CERTIFICATION OF ABATEMENT IS REQUIRED FOR THIS VIOLATION.
