29 CFR 1926.451(g)(1): Each employee on a scaffold more than 10 feet (3.1 m) above a lower level shall be protected from falling to that lower level. Paragraphs (g)(1)(i) through (vii) of this section establish the types of fall protection to be provided to the employees on each type of scaffold. Paragraph (g)(2) of this section addresses fall protection for scaffold erectors and dismantlers. a. On or about August 15, 2012 - at the above addressed jobsite, an employee was offloading bricks from a platform pallet attached to the forks of a PETTIBONE B-66 Rough Terrain Forklift, approximately twenty one (21) feet six (6) inches above the ground, thereby exposing the employee to fall hazards. b. On or about August 15, 2012 - the above addressed jobsite, an employee performing tuckpointing operations from a tubular welded frame scaffold, approximately twenty one (21) feet six (6) inches above the ground, was exposed to injuries from falls due to the lack of guardrails. THE SHANNON VIEW HOMES, INC. WAS PREVIOUSLY CITED FOR A VIOLATION OF THIS OCCUPATIONAL SAFETY AND HEALTH STANDARD OR ITS EQUIVALENT STANDARD 1926.451(g)(1), WHICH WAS CONTAINED IN OSHA INSPECTION NUMBER 92178, CITATION NUMBER 1, ITEM NUMBER 2 AND WAS AFFIRMED AS A FINAL ORDER ON NOVEMBER 10, 2011 WITH RESPECT TO A WORKPLACE LOCATED AT FOUNTAIN VILLAGE, ORLAND PARK, IL 60467.

29 CFR 1926.454(a): The employer shall have each employee who performs work while on a scaffold trained by a person qualified in the subject matter to recognize the hazards associated with the type of scaffold being used and to understand the procedures to control or minimize those hazards. The training shall include the following areas, as applicable: a. On or about August 15, 2012 - at the above addressed jobsite, employees performing tuckpointing operations from a tubular welded frame scaffold were not trained to recognize the hazards associated with the use of such scaffold, thereby exposing employees to the hazards associated with falls. THE SHANNON VIEW HOMES, INC. WAS PREVIOUSLY CITED FOR A VIOLATION OF THIS OCCUPATIONAL SAFETY AND HEALTH STANDARD OR ITS EQUIVALENT STANDARD 1926.454(a), WHICH WAS CONTAINED IN OSHA INSPECTION NUMBER 92178, CITATION NUMBER 1, ITEM NUMBER 1, GROUP d, AND WAS AFFIRMED AS A FINAL ORDER ON NOVEMBER 10, 2011 WITH RESPECT TO A WORKPLACE LOCATED AT FOUNTAIN VILLAGE, ORLAND PARK, IL 60467.
