OSH ACT of 1970 Section (5)(a)(1): Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of falls.    On or about 8/16/12, employees were exposed to a fall from height of approximately 10 ft, while using a industrial powered truck with lift basket attachment without proper fall protection in the course of their normal duties to store material in the warehouse of the San Antonio Plant.

29 CFR 1910.134(c)(2)(ii): The employer did not establish and implement those elements of a written program necessary to ensure that any employee using a respirator voluntarily was medically able to use that respirator, and that the respirator was cleaned, stored, and maintained so that its use does not present a health hazard to the user:    On or about 8/16/12, employees were exposed to inhalation hazards by not providing personnel voluntarily wearing respirators with medical evaluations from a physician nor were they instructed on proper care, cleaning and maintenance to ensure the respirators themselves would not be a hazard.

29 CFR 1910.178(l)(6): The employer did not certify that each operator had been trained and evaluated as required by this paragraph (l):    On or about 8/16/12, the shipping department where employees operated an electric Crown Standup Counterbalanced Truck was exposed to a caught-in and struck-by hazard by not properly being certified and evaluated in the use of a powered industrial truck. Employees utilize the counterbalanced truck to constantly store product and raw material during the course of normal operations.

29 CFR 1910.303(g)(2)(i): Except as elsewhere required or permitted by Subpart S of Part 1910, live parts of electric equipment operating  at 50 volts or more were not guarded against accidental contact by use of approved cabinets or other forms of approved enclosures or by any of the means identified in paragraphs (A), (B), (C), and (D) of 29 CFR 1910.303(g)(2)(i):    On or about 8/16/12, in the Southwest section of the warehouse, employees were exposed to an electrical hazard where the ice machine did not employ a protective cover to prevent employees from accidental electric shock while walking in and around the area.
