29 CFR 1926.451(c)(2)(iv): Front-end loaders and similar pieces of equipment were used to support scaffold platforms without being specifically designed by the manufacturer for such use: On or about August 14, 2012 and times prior thereto on the construction site located at 1674 Batesville Road in Batesville, Arkansas, employees were elevated in a personnel lift/scaffold platform that did not meet the requirements of ASME B56.6 exposing tem to the hazards of a vehicle tip over. The work platform attached to a Sky-Trak rough terrain fork lift extended more than the allowable maximum of 10 inches on either side of the load bearing tires. The personnel platform in use measured approximately 181 inches in length and the distance between the two load bearing tires measured approximately 96 inches. The operator's manual for this vehicle requires that only approved personnel work platforms be used.

29 CFR 1926.451(c)(2)(v): The employer used forklifts to support scaffold platforms without ensuring that the entire platform was attached to the fork and that the forklift was not moved horizontally while the platform was occupied: On or about August 14, 2012 and times prior thereto on the construction site located at 1674 Batesville Road in Batesville, Arkansas, employees occupied a personnel work platform that was being moved laterally while attached to a SKY-TRAK rough terrain forklift exposing them to the hazards of being ejected from the confines of the platform..
