Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that are causing or are likely to cause death or serious physical harm to his employees in that employees were exposed to forklift tip over related hazards:    a) Elevated work locations (fascia) around the gate canopy: On or about August 14, 2012 and at times prior thereto, the lateral stability of the forklift was negatively affected when a personnel lift platform that exceeded the forklifts load bearing wheel base plus 10-inches was used to elevate employee(s) and building materials 17-feet above the ground.  A forklift tip over would expose employee(s) to being struck by and/or crushed by the forklift or its load.

29 CFR 1926.602(c)(1)(ii): Modifications or additions which affect the capacity or safe operation of the equipment were made without the manufacturer's written approval:    a) Lull International Rough-Terrain Forklift: On or about August 14, 2012 and at times prior thereto, the employer allowed the use of personnel lift platform without the written approval and updated load charts which exposed employees to fall and struck-by hazards associated with tip overs.  	  b) Gehl Rough-Terrain Forklift: On or about August 14, 2012 and at times prior thereto, the employer allowed the use of personnel lift platform without the written approval and updated load charts which exposed employees to fall and struck-by hazards associated with tip overs.
