29 CFR 1910.1200(h)(1): Employees were not provided information and training as specified in 29 CFR 1910.1200(h)(1), (2) and (3) on hazardous chemicals in their work area at the time of their initial assignment, and whenever a new physical or health hazard the employees had not previously been trained about was introduced into their work area: a) Cocoa Room - On or about August 16, 2012, Edgar A. Weber & Company did not provide information and training to employees exposed to hazardous chemicals, including dust generated from the cocoa powder manufacturing process. Dust collected by the three Nederman FilterBox dust collectors, dust accumulated on the floor beneath the bag dump station and bagging operation, and dust accumulated on the top of the blender and hopper were all tested and determined to be combustible dust with Kst values ranging between 1.66 bar meters per second (bar*m/s) and 6.55 bar*m/s. In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification. This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence of abatement, or other written records. EDGAR A. WEBER & COMPANY WAS PREVIOUSLY CITED FOR A VIOLATION OF THIS OCCUPATIONAL SAFETY AND HEALTH STANDARD OR ITS EQUIVALENT STANDARD, 29 CFR 1910.1200(h)(1), WHICH WAS CONTAINED IN OSHA INSPECTION NUMBER 314173824, CITATION NUMBER 1, ITEM NUMBER 6, ISSUED ON JUNE 14, 2010, WITH RESPECT TO A WORKPLACE LOCATED AT 549 PALWAUKEE DRIVE, WHEELING, IL 60090.
