29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet or more above lower levels was not protected by guardrail systems, safety net systems, or personal fall arrest systems, nor did the employer demonstrate that it is infeasible or creates a greater hazard to use these systems and develop and implement a fall protection plan which meets the requirements of paragraph (k) of section 1926.502. a) Workers were engaged in a re-roof construction activities tearing off old roofing material and installing new roofing material on a one and half story residential house having a 4 in 12 and 8 in 12 pitch roof sections were exposed to potential fall hazards from heights of 9 feet and greater in that no conventional or personal fall protection were utilized.
