29 CFR 1910.22(c): Covers and/or guardrails were not provided to protect personnel from the hazards of open pits, tanks, vats, ditches, etc.:    On or about  August 14, 2012 and times prior thereto, employees operated a screw conveyor system inside a large waste transfer pit that was not guarded to prevent employees from down into the pit.

29 CFR 1910.23(d)(1)(iii): Stairway(s) less than 44 inches wide having both sides open, did not have one stair railing on each side:    On or about August 14,  2012 and times prior thereto, employees used metal stairs to gain access to a waste pit, the stairs did not have hand rails installed on both open sides to prevent accidental falls off stairs.

29 CFR 1910.147(c)(1): Energy control program. The employer shall establish a program consisting of energy control procedures, employee training and periodic inspections to ensure that before any employee performs any servicing or maintenance on a machine or equipment where the unexpected energizing, startup or release of stored energy could occur and cause injury, the machine or equipment shall be isolated from the energy source and rendered inoperative.    On or about August 14,  2012 and times prior thereto, the employer had not developed an energy control program for employees who performed servicing and maintenance work on equipment and machinery and were not protected from the unexpected engizing, start up or released or stored energy.

29 CFR 1910.1200(e)(1): Employers shall develop, implement, and maintain at each workplace, a written hazard communication program which at least describes how the criteria specified in paragraphs (f), (g), and (h) of this section for labels and other forms of warning, safety data sheets, and employee information and training will be met, and which also includes the following:    On or about August 14, 2012 and times prior thereto, the employer did not develop a Hazard Communication Program for employees using hazardous chemicals, such as but not limited to Rust-Oleum enamel paints, Pro-Chem cleaning system degreasers, oils, lubricatants, and antifreeze.
