29 CFR 1926.651(k)(1): An inspection of the excavations, the adjacent areas, and protective systems was not conducted by the competent person prior to the start of work and as needed throughout the shift: (a) In Front of the Railroad Store - The site did not have a competent person in that the person in charge did not have knowledge of the requirements of the trenching and excavation standards, and no inspection of the trench occurred prior to an employee starting to work in the trench to ensure that the trench had adequate cave-in protection. An employee worked in a trench 5 feet 7 inches deep, 5 feet 11 inches wide, and 43 feet long, dug in Type B soil, with vertical side walls and no cave-in protection, on or about July 25, 2012. Abatement certification is required within 10 days after the abatement date. The certification shall include a statement that abatement is complete, the date and method of abatement, and state that employees and their representatives were informed of this abatement.
