OSH ACT of 1970 Section (5)(a)(1): Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard(s) of crushing and struck-by: a) Throughout the welding and cutting areas, on or about and at times prior to August 15, 2012, the employer did not ensure employees knew and understood the safe operation and use of hooks with functional safety latches in that hooks used once had safety latches and were damaged and continued to be used, which exposed employees to crushing and struck by hazards. Among other methods, feasible and acceptable methods to correct this hazard included but are not limited to: 1. Conduct frequent and periodic inspections of the lifting device in accordance with ASME B.30.10 Harris Waste Management Group, Inc., was previously cited for a violation of this occupational safety and health standard or its equivalent standard P.L. 91-596 section 5(a)(1), which was contained in OSHA inspection number 314094087, citation number 1, item 001 and was affirmed as Informal Settlement Agreement on January 5, 2012, with respect to a workplace located at 315 West 12th Ave., Cordele, Georgia. ABATEMENT CERTIFICATION AND DOCUMENTATION ARE REQUIRED
