On or about August 15, 2012, at the above addressed jobsite, employees were working in and near the traveled way without providing advanced warning to roadway users of roadwork activity, thereby exposing the employees to struck-by hazards. Abatement certification is required of this item in accordance with the requirements of 29 CFR 1903.19(c).

29 CFR 1926.652(a)(1): Each employee in an excavation were not protected from cave-ins by an adequate protective system designed in accordance with paragraph (b) or (c) of this section: a. On or about August 15, 2012, at the above addressed jobsite, employees were installing a vault in an excavation measured at eleven (11) feet in depth. The excavation was not provided with cave in protection, thereby exposing the employees to cave-in hazards. THE LINO & POLI PLUMBING, INC., WAS PREVIOUSLY CITED FOR A VIOLATION OF THIS OCCUPATIONAL SAFETY AND HEALTH STANDARD OR ITS EQUIVALENT STANDARD 29 CFR 1926.652(a)(1), WHICH WAS CONTAINED IN OSHA INSPECTION NUMBER 312726839, CITATION NUMBER 2, ITEM NUMBER 1 AND WAS AFFIRMED AS A FINAL ORDER ON JULY 22, 2009 WITH RESPECT TO A WORKPLACE LOCATED AT 201 CHURAN WAY, SOUTH ELGIN, ILLINOIS. Abatement documentation is required for this item in accordance with the requirements of 29 CFR 1903.19(d).
