OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that:    On or about August 16, 2012, employees were performing oil change on a vehicle using a John Dow Crew Chief Fluid Evacuator, when the attached glass oil reservoir exploded at Manhattan Automobile Company, in the Jaguar Service Department on the fifth floor.    NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM, FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1,000.00 AS PER 29 CFR 1903.19.

Manhattan Automobile Company, New York, NY    On or about 08/16/12,    The employer did not ensure that service technicians operating John Dow Crew Chief Fluid Evacuator use eye protection as prescribed by the manufacturer.    NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM,  FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1,000.00 AS PER 29 CFR 1903.19.
