29 CFR 1926.102(a)(1): Eye and face protective equipment were not used when machines or operations presented potential eye or face injury from physical, chemical, or radiation agents. The employer does not ensure that employees wear eye protection when operations present potential eye injury hazards. This violation was observed on or about August 14, 2012, at the construction site when two employees were exposed to a stuck-by hazard while operating a circular saw without wearing eye protection. Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the abatement date, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to ensure that all employees are provided with and are required to use personal protective equipment needed to protect against hazards.
