(a) Location 29  Hudson Road, Sudbury, Ma:  On or about 08/14/2012, a rod iron railing was being utilized as a guardrail, the top of the guardrail system was not at least 39 inches high.

29 CFR 1926.502(b)(3):     Guardrail systems shall be capable of withstanding, without failure, a force of at least 200 pounds (890 N) applied within 2 inches (5.1 cm) of the top edge, in any outward or downward direction, at any point along the top edge.    (a) Location 29  Hudson Road, Sudbury, Ma:  On or about 08/14/2012, a rod iron railing was being utilized as a guardrail system, an employee fell to the ground when the railing had broken when the employee exerted pressure upon it.
