OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazards of deflagration and fire:    On or about August 12, 2012, and at times prior thereto, within the Headhouse of the Madison Port Facility, the employer failed to ensure that Bucket Elevators #1 and #3 were adequately vented along the length of the legs at a minimum of 20 foot intervals.     Among other methods, two feasible and acceptable abatement methods to correct this hazard would be to install deflagration venting per NFPA 61, Chapter 7. In lieu of venting a deflagration suppression system per NFPA 69, Chapter 10 Deflagration Control by Suppression. An essential element of such an installation would be to select a design that has been tested under deflagration conditions as a verification to its performance.
