29 CFR 1926.251(a)(1): Rigging equipment for material handling shall be inspected prior to use on each shift and as necessary during its use to ensure that it is safe. Defective rigging equipment shall be removed from service. On or about 08/10/2012, the employer did not ensure that wire rope slings were inspected prior to use and that defectives slings were removed from service. The employer was lifting bundles of rebar to the roof of the structure using a wire rope sling that was permanently deformed and crushed.

29 CFR 1926.251(c)(7): Sling legs shall not be kinked. On or about 08/10/2012, the employer did not ensure that wire rope slings that had been permanently deformed/kinked, were removed from service. The employer was using wire rope slings that were kinked and crushed to lift bundles of rebar weighing approx 626 lbs to the roof of the structure.
