29 CFR 1926.502(f)(1)(i): When no mechanical equipment was being used the warning line was not erected at least 6 feet (1.8m) from the roof edge: (a) Main Roof of the Building - The warning line system used as fall protection did not comply with the standard in that the warning line had a distance from the west edge of the roof of 4 feet 7 inches and part of the warning line had a distance from the south edge of the roof on the side of the building occupied by medical offices of 4 feet, exposing employees to a fall hazard of 13 feet 4 inches, on or about August 21, 2012.

29 CFR 1926.501(b)(10): Each employee engaged in roofing activities on low-slope roofs with unprotected sides and edges 6 feet or more above lower levels, was not protected from falling by guardrail systems, safety net systems, personal fall arrest systems, or a combination of warning line system and guardrail system, warning line system and safety net system, or warning line system and personal fall arrest system, or warning line system and safety monitoring system. Or, on roofs 50-feet (15.25 m) or less in width, each employee was not protected by use of a monitoring system: (a) Roof over Post-Op/Pre-Op Area - An employee worked installing metal coping along the edge of the flat roof, which had dimensions of 33 feet by 9 feet and a height above the ground of 12 feet 4 inches. This employee wore a harness and lanyard but did not tie off, and this employee did not use any other form of fall protection, including a safety monitoring system, on or about August 21, 2012. (b) Roof over Doctors' Office - An employee worked installing metal coping along the edge of the flat roof, which had dimensions of 27 feet 4 inches by 9 feet and a height above the ground of 12 feet 4 inches. This employee wore a harness and lanyard but did not tie off, and this employee did not use any other form of fall protection, including a safety monitoring system, on or about August 21, 2012. NICHOLAS EVANOFF COMPANY WAS PREVIOUSLY CITED FOR A VIOLATION OF THIS OCCUPATIONAL SAFETY AND HEALTH STANDARD OR ITS EQUIVALENT STANDARD 1926.501(b)(10), WHICH WAS CONTAINED IN: OSHA INSPECTION NUMBER 314247313, CITATION NUMBER 1, ITEM NUMBER 1, AND WAS AFFIRMED AS A FINAL ORDER ON SEPTEMBER 6, 2011, WITH RESPECT TO A WORKPLACE LOCATED AT 1700 SOUTH LINCOLN AVENUE, BUILDING 17, LEBANON, PENNSYLVANIA 17042; AND OSHA INSPECTION NUMBER 314242314, CITATION NUMBER 1, ITEM NUMBER 1, AND WAS AFFIRMED AS A FINAL ORDER ON DECEMBER 17, 2010, WITH RESPECT TO A WORKPLACE LOCATED AT 54 NORTH MIDDLESEX ROAD, CARLISLE, PENNSYLVANIA 17013; AND OSHA INSPECTION NUMBER 113743900, CITATION NUMBER 1, ITEM NUMBER 1, AND WAS AFFIRMED AS A FINAL ORDER ON FEBRUARY 22, 2010, WITH RESPECT TO A WORKPLACE LOCATED AT 1700 SOUTH LINCOLN AVENUE, LEBANON, PA 17042.

(a) Main Roof of the Building - The warning line system used as fall protection did not comply with the standard in that along the north edge of the roof over the surgical area of the building, the warning sagged down to the level of the roof, and along the south edge of the roof, the warning line sagged to 14 inches above the roof, exposing employees to a fall hazard of 13 feet 4 inches, on or about August 21, 2012. NICHOLAS EVANOFF COMPANY WAS PREVIOUSLY CITED FOR A VIOLATION OF THIS OCCUPATIONAL SAFETY AND HEALTH STANDARD OR ITS EQUIVALENT STANDARD 1926.502(f)(2)(ii), WHICH WAS CONTAINED IN OSHA INSPECTION NUMBER 113740476, CITATION NUMBER 1, ITEM NUMBER 1, AND WAS AFFIRMED AS A FINAL ORDER ON SEPTEMBER 12, 2011, WITH RESPECT TO A WORKPLACE LOCATED AT 1700 SOUTH LINCOLN AVENUE, LEBANON, PENNSYLVANIA 17042.
