Controls to limit the operators of the lift were not put in place exposing employees to a fall of approximately 21 feet.

29 CFR 1926.453(b)(2)(iv): Employee(s) working in an aerial lift were sitting or climbing on the edge of the basket: (a) On or about 08/20/12 a JLG 400 Series Telescopic Boom Lift rented from United Rentals was used at the construction of the WAWA Convenience Store at 2901 E Fowler Avenue, Tampa FL. An employee was observed exposed to a fall of approximately 21 feet when he climbed over the rails of the aerial lift to access the roof of the building.

29 CFR 1926.453(b)(2)(vi): Boom and basket load limits specified by the manufacturer were exceeded: (a) On or about 08/20/12 a JLG 400 Series Telescopic Boom Lift rented from United Rentals was used at the construction of the WAWA Convenience Store at 2901 E Fowler Avenue, Tampa FL. At one point, four employees were observed travelling exceeding the limit of two established by the lift the manufacturer. This exposed the employees to a fall of approximately 21 feet.
