29 CFR 1910.1200(d)(5)(iv): Where chemical manufacturer, importer, or employer have evidence to indicate that a component present in the mixture in concentrations of less than one percent (or in the case of carcinogens, less than 0.1 percent) could be released in concentrations which would exceed an established OSHA permissible exposure limit or ACGIH Threshold Limit Value, or could present a health risk to employees in those concentrations, the mixture was not assumed to present the same hazard. (a) Facility-wide: On August 21, 2012 and at times prior to; the chemical manufacturer provided to its customers material safety data sheets that did not list Beryllium as a component for their product "Black Blast" exposing the employees of its customers to health hazards associated with Beryllium released in amounts in excess of OSHA's Permissible Exposure Level.
