29 CFR 1926.501(b)(13):      Each employee engaged in residential construction activities 6 feet or more above lower levels was not protected by guardrail systems, safety net systems, or personal fall arrest systems, nor did the employer demonstrate that it is infeasible or creates a greater hazard to use these systems and develop and implement a fall protection plan which meets the requirements of paragraph (k) of section 1926.502:        a) Inside of the structure: On August 8, 2012, and at times prior thereto, employees performing framing activities were exposed to an 8 foot fall hazard at the open sided floor around the top of the stairway opening where a guardrail system was not in place.       b) Front of the structure: On August 8, 2012, and at times prior thereto, employees were exposed to 9 foot fall hazards into the window wells where the window openings that were 24 inches high, did not have a guardrail or other barrier in place.         c) Front of the structure: On August 8, 2012, and at times prior thereto, employees were exposed to a 9 foot fall hazard into the concrete area below a wall opening that did not have a guardrail or other barrier in place.         d) Exterior of the structure: On August 8, 2012, and at times prior thereto, employees were exposed to a 13 foot fall hazard to the ground below while setting trusses from the exterior top plate without a fall protection system in place.       Note) Abatement certification IS required for this item.
