29 CFR 1926.21(b)(2): The employer did not instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his/her environment to control or eliminate any hazards or other exposure to illness or injury: a) On or about 08/21/12, on the jobsite at apartment building located at "97 Oliver St. & 1115 University Ave" in Rochester, NY: Employees were exposed to falls while engaged in roofing work on a steep roof & accessing the roofs using extension ladders. They also also used extension cords & electrical saws. The employees were not trained about Osha fall protection regulations, ladder safety regulations, electrical regulations and applicable OSHA regulations pertaining to other hazards that the employees may potentially be exposed to when engaged in roofing work. ABATEMENT CERTIFICATION REQUIRED

29 CFR 1926.404(b)(1)(i): Employer did not use either ground fault circuit interrupters as specified in paragraph (b)(1)(ii) of this section, or an assured equipment grounding conductor program as specified in paragraph (b)(1)(iii) of this section to protect employees on construction sites. a) On or about 08/21/12, on the "1115 University Ave." side of the apartment building in Rochester, NY: An employee used a DeWalt Model DW368 Circular Saw to cut plywood sheets. The saw was connected to 120-volt ac power via an extension cord which was plugged into an outdoor receptacle on the side of the house. No GFCI or assured equipment grounding program was being used. NO ABATEMENT CERTIFICATION REQUIRED

The roof pitch was estimated to be approx. 10 in 12. NO ABATEMENT CERTIFICATION REQUIRED
