29 CFR 1926.454(a): The employer did not have each employee who performs work while on a scaffold trained by a person qualified in the subject matter to recognize the hazards associated with the type of scaffold being used and to understand the procedures to control or minimize those hazards: On August 22, 2012, on the northeast side of a residential construction, an employee was applying Dupont Tyvek Stucco Wrap to the wall of the building, while standing on a pumpjack, approximately 16 feet from the ground, without having had training in recognizing the need for fall protection.

29 CFR 1926.451(g)(1): Each employee on a scaffold more than 10 feet (3.1 m) above a lower level was not protected from falling to that lower level. Paragraphs (g)(1)(i) through (vii) of this section establish the types of fall protection to be provided to the employees on each type of scaffold: On August 22, 2012, an employee was exposed to a fall of approximately 16 feet to the ground below, while applying stucco wrap from a pumpjack without any fall protection.
