OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employee(s) were exposed to struck-by hazards: a) On or about 08/21/2012, an employee completing rigging operations under the bucket, or in its immediate proximity, was struck in the head by the bucket because it had not been locked out using the "Safety Locking System" (lockout lever).

29 CFR 1926.251(b)(6)(ii): Record(s) of the most recent month in which each alloy steel chain sling was thoroughly inspected were not available for examination: a) for alloy steel chain slings such as that observed on or about 08/21/2012. The chain sling(s) were connected to portable equipment and the eye on the bottom of an excavator bucket to make lifts. The employer did not make and maintain inspection records for the chain slings.
