29 CFR 1926.100(a):     Employees working in areas where there was a possible danger of head injury from impact, or falling or flying objects, or from electrical shock and burns, were not protected by protective helmets:    (a)    South Side of Building - On or about August 20, 2012 employees were exposed to being struck by falling objects, such as, hammers. Employees working on ground below scaffold were not wearing hard hats.

29 CFR 1926.451(b)(1)(i):     Each platform unit (e.g., scaffold plank, fabricated plank, fabricated deck, or fabricated platform) was not installed so that the space between adjacent units and the space between the platform and the uprights were no more than 1 inch (2.5 cm) wide, except where the employer can demonstrate that a wider space is necessary.    (a)    South Side of Building - On or about August 20, 2025 employees were exposed to fall hazards while working from a scaffold over 13 feet in height. Scaffold did not have a fully planked working level.

29 CFR 1926.451(c)(2):     Supported scaffold poles, legs, posts, frames, and uprights did not bear on base plates and mud sills or other adequate firm foundation:    (a)   South Side of Building - On or about August 20, 2012 employees were exposed to fall hazards while working from a scaffold over 13 feet tall.  Mud sills were not provided under scaffold base plates. Scaffold base plates were resting on wet soil.

29 CFR 1926.451(g)(1)(vii):     Each employee on a scaffold, not otherwise specified in paragraphs (g)(1)(i) through (g)(1)(vi) of this section, more than 10 feet (3.1 m) above lower level was not protected from falls by the use of personal fall arrest systems or guardrail systems meeting the requirements of paragraph (g)(4) of this section.    (a)   South Side of Building - On or about August 20, 2012 employees were exposed to fall hazards while working from a scaffold 13 feet tall. Employees were not protected from falling to a lower level by guardrail systems or personal fall arrest systems.
